# Chalet Franzi – Dorfgastein ## General Terms & Conditions (GTC), Privacy Policy & Cancellation Policy **Version: November 2025** # General Terms and Conditions (GTC) ## 1. Scope These General Terms and Conditions (GTC) apply to all bookings and stays at Chalet Franzi. By making a booking, the guest accepts these terms and conditions. ## 2. Booking and Conclusion of Contract • Bookings can be made by telephone, email, or online. • The contract becomes binding upon receipt of the written booking confirmation. • A booking is only considered confirmed after receipt of the deposit or full payment. • Separate cancellation terms apply to direct bookings. • For bookings made through platforms (Booking.com, Airbnb, etc.), the respective platform terms and conditions apply. ## 4. Prices and Payment • All prices are stated in Euro and include VAT. • Included: bed linen, towels, final cleaning, and, where applicable, admission to the Solarbad swimming pool in summer • Not included: tourist tax and optional additional services. ### Payment Terms • 30% deposit upon booking. • Remaining balance due according to prior agreed terms. • Short-notice bookings require full payment immediately. ## 5. Tourist Tax A tourist tax of €2.85 per person per night applies to guests aged 15 years and older. Children up to 14 years are exempt. ## 6. Security Deposit • A security deposit of €300.00 is payable upon arrival. • The deposit will be refunded after inspection of the accommodation. • Any damages or additional cleaning costs will be deducted. ## 7. Arrival and Departure • Check-in: from 4:00 PM. • Check-out: until 10:00 AM. • Personal key handover upon arrival. • Please inform us in advance in case of delayed arrival. ## 8. Occupancy and Use • Maximum occupancy: 9 persons. • Parties and commercial use of the property are not permitted. ## 9. Pets • Additional fee of €85.00 per pet. • Pets are not allowed on furniture or beds. • Pets may not be left unattended in the accommodation. • Guests are liable for any damage caused by their pets. ## 10. Smoking Smoking is strictly prohibited inside all indoor areas of the property. ## 11. Guest Obligations • Treat the accommodation and its inventory with care. • Comply with the house rules. • Report any damage immediately. • Leave the accommodation in a reasonably clean condition upon departure. ## 12. Liability of the Landlord • The landlord shall not be liable for events of force majeure or actions of third parties. • Liability for slight negligence is excluded to the extent permitted by law. ## 13. Liability of the Guest The guest is liable for all damages caused by themselves, accompanying persons, or pets. ## 14. Warranty and Defects Any defects or complaints must be reported immediately. Minor defects do not entitle the guest to a reduction of the rental price. ## 15. Cancellation • Direct bookings are subject to Chalet Franzi’s cancellation policy (see below). • Bookings made through booking platforms are subject to the respective platform's cancellation rules. • The effective date of cancellation is the date the written cancellation is received. ## 16. Data Protection The Privacy Policy below shall apply. ## 17. Severability Clause Should any provision of these Terms and Conditions be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. ## 18. Applicable Law and Jurisdiction Austrian law shall apply. What Data Do We Collect? • Contact details (name, address, email, telephone number). • Booking information (travel dates, number of guests, special requests). • Payment information (bank account details and/or credit card information). • Identification data as required by Austrian registration laws. ## 4. Purpose of Data Processing • Processing and managing bookings. • Communication with guests. • Issuing invoices. • Compliance with legal obligations and registration requirements. ## 5. Legal Basis • Performance of a contract (Art. 6(1)(b) GDPR). • Compliance with legal obligations (Art. 6(1)(c) GDPR). • Consent (Art. 6(1)(a) GDPR). ## 6. Sharing of Data Personal data will only be shared where legally required or necessary for payment processing. ## 7. Data Retention Period • Booking data: 7 years. • Registration data: as required by Austrian law. • Newsletter data: until consent is withdrawn. ## 8. Cookies and Website Only technically necessary cookies are used. ## 9. Guest Rights Guests have the right to: • Access their personal data. • Rectification of inaccurate data. • Erasure of data. • Restriction of processing. • Data portability. • Object to processing. • Lodge a complaint with the Austrian Data Protection Authority. ## 10. The current version is available online. --- # Cancellation Policy **Version: October 2025** ## 1. Cancellation Terms (Direct Bookings) • Up to 60 days before arrival: free cancellation. • 59–31 days before arrival: 50% cancellation fee. • Less than 31 days before arrival: 100% cancellation fee. • No-show: 100% of the total booking amount. ## 2. Cancellation by the Landlord • In cases of force majeure, cancellation is free of charge. • If the landlord cancels without a valid reason, a full refund will be issued. ## 3. Form of Cancellation • Cancellations must be submitted in writing by email or letter. • The date of receipt of the cancellation is decisive. ## 4. Travel Cancellation Insurance We strongly recommend taking out travel cancellation insurance. ## 5. Rebookings • Up to 60 days before arrival: free of charge (subject to availability). • 59–39 days before arrival: €50.00 administration fee. • Less than 39 days before arrival: rebooking is no longer possible. ## 6. Early Departure No refund will be granted for early departure. ## 7. Force Majeure / Pandemic Situations In cases of force majeure or similar extraordinary circumstances, a free rebooking or voucher may be offered. ## 8. Refunds Refunds will be processed within 14 days.
